Catagories:

Denied visa applications can be heartbreaking. Just imagine hoping to see the family that you haven’t seen in years and being denied the only way you can be reunited. Although you might not know, there are ways you can appeal your rejection decision, depending on the type of visa you have applied for. Here are three things you can do if your Canadian visa gets rejected.

Appealing

Your visa refusal will determine if appealing your rejection is a good decision. Appealing is only a good option if you believe that your immigration officer was in the wrong to reject your application. Make sure to hire the right legal professionals to advise you on the matter and appeal the rejection if possible.

There are two types of appeals. One is made to the Federal Court of Canada, while the other is made to the Immigration Appeal Division (IAD).

The appeal made to the Federal Court is done through Judicial Review. The purpose of this appeal is to prove that the immigration officer acted unfairly. Some deadlines need to be met for these types of appeals. If you receive the rejection while you’re in Canada, you must appeal the decision within 15 days. If you’re outside Canada, the appeal must be made within 60 days.

Although IAD doesn’t handle visa applications, however, if you’re being sponsored and your sponsor’s application was denied, they’ll have to appeal to the IAD.

Reconsideration

If you believe that your application was rejected due to lack of information or a misunderstanding, you can request a reconsideration and include additional supporting documents that prove that the grounds for the visa refusal were due to lack of information provided.

Re-Applying

You can always re-apply for your Canadian visa. If you believe that your condition has changed significantly, you should definitely consider a reapplication. Make sure to provide supporting documents with your visa application to ensure that there are no grounds for refusal. Make sure to go through your previous reasons for refusal and provide information regarding how the situation is different now.
