Contracts consist of plans and agreements that both parties find in their best interest. Even the most thought-out plans can take a U-turn, creating a huge fuss. If you’re in a contract that has turned upside down due to a problem from one end or a disagreement in the future, then the best thing is to hire a lawyer to resolve the issues.

Contract disputes can be resolved in multiple ways, including mediation, arbitration, collaborative law, or traditional litigation.

Mediation

A third-party mediator is involved in the mediation process that helps resolve the dispute by negotiation. The mediator is usually a trained individual who is an expert at effective listening, negotiation techniques, and restating the position of the involved parties. The mediator helps both parties come to a solution rather than deciding on their behalf.

Arbitration

Arbitration is somewhat similar to mediation, with the only difference being that the mediator gives the decision at the end, which legally binds both parties in an agreement. Either one or a panel of arbitrators can decide on the case. The whole case is handled similarly to a trial where evidence is presented, and arguments are made from both ends. The decision by arbitrators will be final at the end, but the ruling can be appealed.

 Contract papersCollaborative Law

The Collaborative Law is another method of dispute resolution in which the lawyers of both parties decide to conclude without going to the court. A set of meetings is held where the negotiations occur between both parties. The whole process is confidential, and both parties control the terms of the settlement.

Traditional Litigation

Lastly, the disputes can be resolved in court by presenting evidence and arguments. It is an expensive process, which is why many parties decide to resolve the case outside of the court. It’s the common method to resolve a dispute.
