Canada announced that they have dropped the requirement of police clearance certificates as a mandatory requirement for temporary residents’ visas which also includes study permits.  

In a startling revelation during Monday’s House of Commons Standing Committee on Citizenship and Immigration session, Canada’s Minister of Immigration, Refugees, and Citizenship, Marc Miller, responded to relentless questioning from Indo-Canadian MP Arpan Khanna with an unexpected statement: “I have never stated that such certificates are required for temporary residents.” 

While this statement provides some clarity on the immigration process, it does raise concerns about potential security risks. How might this be the case? For example, if certificates are not required for temporary residents, it could mean that certain critical background checks or verifications are being overlooked. This might allow individuals with questionable histories or intentions to enter the country more easily.  

The Nijjar Case: A Spotlight on Canada’s Immigration Screening

Simplifying immigration procedures is undoubtedly attractive. It streamlines the process for skilled workers and students, attracting talent that contributes to Canada’s economic and social fabric. However, national security still remains a matter of utmost importance. For example, one can take the shocking murder case of Hardeep Singh Nijjar, a pro-Khalistan leader in Canada. Three Indian nationals were accused of his killing, out of which two of them had entered Canada via study permits, while the third had previously studied in Canada. This event raised serious questions about the effectiveness of the existing screening system for temporary residents. 

Nijjar’s case escalated into a political matter when Canada alleged India’s involvement in the killing. In response, India’s External Affairs Minister countered, stating that Canada has been welcoming individuals with links to organized crime from Punjab. He remarked, “We have been telling Canada, saying, look, these are wanted criminals from India, you have given them visas.” This statement was challenged on May 6 when Marc Miller asserted, “We’re not lax. And the Indian foreign minister is entitled to his opinion. I’m going to let him speak his mind. It’s just not accurate.” 

Police Certificates vs. Biometric Verification: Is There a Better Option? 

Marc Miller, the minister of IRCC, argues that traditional police certificates, often obtained from home countries with limited electronic record-keeping, may not paint a complete picture. He glorifies his department’s rigorous screening methods, including biometric verification—which includes fingerprints and facial recognition—is more effective than police clearance certificates. Nevertheless, it must be noted that while this is a more reliable identification tool, its effectiveness largely depends on the cooperation of source countries in electronically recording criminal activity. 

What Does This Mean for Potential Immigrants? 

Not requiring of police clearance certificates removes a hurdle for people aiming for temporary residence in Canada, but it doesn’t eliminate the screening process altogether. IRCC will continue its background checks, and potential immigrants should be prepared to provide additional documentation or undergo further screening if required by an investigation officer.
