An asylum is a form of a stay in a country that you’re given when you feel like you will be harmed or in danger when you enter your country of origin. There are two places you can apply for asylum, the port of entry or the Immigration, Refugees, and Citizenship Canada (IRCC) if you’re already living in Canada. Eligibility Interview
After you claim asylum at the places mentioned above, officials will have a detailed interview with you to determine whether you are eligible for the criteria or not. Essentially, this is the first stage of your process, and your application will not be forwarded to the Immigration and Refugee Board of Canada (IRB).
You may not be considered for asylum due to the following reasons:
- You’re already given refugee status in another country.
- You entered Canada from the US border.
- You’ve already been rejected for asylum before.
- Have had criminal or human rights violations records.
Referral to IRB
If you’re eligible for asylum status, the officials will forward your application to the IRB. Note that the IRB works independently to determine all the refugee and immigration decisions. This step is where you’ll need our help because the IRB requires documentation and evidence to support your claim which can be hard. Decision
Once your application is processed, you will receive a decision, and if it’s positive then you will have refugee status which can later be used to file for permanent residence. However, if it’s rejected; you don’t have to worry as you can appeal for the rejection within fifteen days of the decision.
